The Supreme Court declares that the control of legality for collective agreements falls outside the powers attributed to it by law.
News
- Spanish government extends ban on dismissals until September 2026 and strengthens sustainable commuting plans
- Labor and employment obligations under the Artificial Intelligence Act have been postponed to December 2, 2027
- The Government is moving forward with approval of the new working hours register and transposing the directives on pay transparency and transparent working conditions
- The Committee of Ministers of the Council of Europe approves a recommendation to Spain on compensation for unfair dismissal
Judgments
- The drafting by employers of standard remote working agreements without prior collective bargaining is not a breach of freedom of association
- Compensation for public holidays to employees working rotating shifts for continuous manufacturing operations is not applicable where already included in the calendar
- Proof taken from workers’ electronic devices is lawful where there was a company policy for their use
- In cases of continuous harassment at work, the dismissal letter does not need to specify the date of each alleged act
- The obligation to make reasonable adjustments for a worker with total permanent disability cannot be extended to apply to other companies in the business group
