New exposure limits to carcinogen agents and asbestos set in Spain
Spain -
Two royal decrees have toughened, starting on October 24, 2026, the exposure limit values for lead, diisocyanates and asbestos, which will make it obligatory for affected companies to review their prevention measures.
Royal Decree 846/2026 of October 21, 2026, implements Directive (EU) 2024/869 and amends Royal Decree 665/1997, on carcinogenic, mutagenic or reprotoxic agents, and Royal Decree 374/2001, on chemical agents and Royal Decree 847/2026 of October 21, 2026, on work involving a risk of asbestos exposure, implements Directive (EU) 2023/2668 and replaces Royal Decree 396/2006, which is now repealed.
The main new provisions are listed below:
- Lead and diisocyanates: the exposure limit values for lead and inorganic lead compounds have been reduced and binding environmental limit values have been established for diisocyanates, with transitional values in effect until December 31, 2028. Companies with exposure to these agents must review their risk assessments, measurements, and health surveillance.
- Asbestos: a new exposure limit has been set. The legislation is part of the goal to eliminate asbestos in the European Union within a reasonable time period. The orderly and safe removal of asbestos and its replacement with non-hazardous materials therefore take priority over any other form of handling, which means companies must adapt their risk assessments and measurements.
The two royal decrees take effect on October 24, 2026.
