Mexico: New regulation of the Geothermal Law for the responsible use of geothermal resources published
This new legal instrument regulates the provisions of the Geothermal Law governing the exploration, exploitation, and sustainable utilization of geothermal resources in the national subsoil, ensuring their rational use for power generation and other applications.
On October 3, 2025, the Regulation of the Geothermal Law was published in the Diario Oficial de la Federación (DOF). The regulation governs the activities of: (i) exploration, (ii) exploitation, and (iii) diverse uses for geothermal utilization (subsurface heat).
The Ministry of Energy (SENER) must ensure that any energy permit or concession is consistent with the sector’s binding planning instruments.
The Federal Electricity Commission (CFE) must annually prepare a portfolio of geothermal projects for electricity generation, taking into account technical and economic factors and the needs of the National Electric System, while SENER will promote public-private collaborations to strengthen geothermal exploration and encourage investment in clean energy.
