Mexico: CNE initiates expiration proceedings in respect of 132 hydrocarbon, petroleum product and petrochemical marketing permits
Through the relevant resolution, the National Energy Commission (CNE) announced the initiation of administrative expiration proceedings against multiple permit holders for the marketing of various products, based on alleged inactivity.
On October 27, 2026, the CNE published in the Official Gazette of the Federation a resolution initiating administrative expiration proceedings against the holders of 132 permits for the marketing of hydrocarbons, petroleum products and petrochemicals, on the grounds that they allegedly fall within the expiration scenario set forth in Article 88, section I (b) of the Hydrocarbons Sector Law.
The resolution is based on a decision adopted by the CNE’s Technical Committee at its meeting held on October 13, 2026. The expiration proceedings arise from the apparent failure to exercise the rights granted under the relevant permit for a period of 365 consecutive calendar days, from September 1, 2025 to August 31, 2026.
The administrative expiration proceedings are to be conducted separately in respect of each permit listed in the resolution. Permit holders are granted a period of 15 business days following service of notice to submit their arguments and supporting evidence.
