Mexico: CNE establishes temporary registration program to identify and regularize self-consumption fuel dispatch activities nationwide

Through this registration program, the National Energy Commission (CNE) allows eligible operators to continue carrying out their activities under defined parameters until the corresponding regulatory framework is issued. The measure seeks to avoid disruptions to ongoing operations and provide regulatory certainty regarding the scope of these activities in accordance with the Hydrocarbons Sector Law.

On August 11, 2026, the CNE published in the Official Gazette of the Federation the resolution establishing the registration program for individuals operating facilities where self-consumption fuel dispatch activities are conducted. The purpose of the program is to create a temporary and exceptional registration mechanism for parties currently engaged in self-consumption fuel dispatch activities while they apply for and obtain the corresponding permit to be issued by the CNE.

The program is generally applicable and mandatory throughout Mexico for parties carrying out such regulated activity that do not hold the corresponding permit as of the date on which the program becomes effective. Holders of fuel distribution or fuel marketing permits are not required to register under the program.

Registration does not constitute an authorization, permit, or favorable determination regarding the legality or admissibility of the activity. Rather, it temporarily enables registered parties to continue conducting self-consumption fuel dispatch activities until the applicable regulations are issued and the corresponding permits are applied for. Such activities must be conducted under conditions that ensure industrial safety, operational safety, and environmental protection, in accordance with national and international best practices.

Registration period and registration process

The registration period begins upon the program's entry into force (August 12, 2026) and will remain open through december 31, 2026. Once this period concludes, only parties that have obtained the corresponding registration certificate may continue carrying out self-consumption fuel dispatch activities. Such certificate will have legal effect solely with respect to the facilities covered by the registration.

Interested parties must complete the electronic registration form available through the CNE's website and comply with the format and documentary requirements set forth in annex 1 of the program.

Among the technical information required are the following:

  • Georeferenced site plan showing the boundaries of the property where the facilities are located;
  • Types of fuels handled at the facilities;
  • Description of the number and type of storage tanks, including their nominal volumetric capacity;
  • Number of dispatch systems installed and their configuration (dispensers, loading arms, or other equipment);
  • List of motor vehicles supplied through the facilities;
  • Total annual volume of fuels allocated to self-consumption dispatch activities during 2024, 2025, and 2026, broken down by month, product, and volume (liters).

Once the required information has been submitted through the electronic platform, the CNE must issue the corresponding registration certificate automatically.

The CNE must also publish and keep updated a list of registered parties so that fuel marketers and distributors may verify the validity of a registration before supplying the corresponding fuels.

Specific regulation and permit requirements for self-consumption activities

Following the conclusion of the registration period, the CNE will have up to 12 months to issue the regulations governing the granting of permits for self-consumption fuel dispatch activities.

Once such regulations are issued, interested parties must apply for and obtain the corresponding permit from the CNE in accordance with the requirements, obligations, and deadlines established therein. Parties duly registered under the program may continue carrying out self-consumption fuel dispatch activities until the deadline for obtaining the applicable permit expires.
