One of the last pending regulations for the development of the General Audiovisual Communications Act is submitted to public hearing

The Ministry of Economic Affairs has published today the draft royal decree regulating the requirements for being considered a “special interest user”. This regulation is subject to a public hearing. Interested parties may submit their allegations until 20 December 2023.

The royal decree establishes two essential requirements to be considered a “special interest user”:

  1. Obtaining “significant revenue”, equal to or greater than €500,000, in the previous financial year. These revenues must be related to their activity in a video-sharing platform (e.g., payments for commercial communications -collaborations or branded content-, user payments, etc.).
  2. “Significant audience”, based on an average number of followers equal to or greater than 2 million users in the previous year and having uploaded at least 24 videos.

What are the next steps before the regulation is passed? For the moment, any interested party can send their allegations to the Ministry until 20 December. Likewise, the necessary reports will be obtained from bodies such as the National Markets and Competition Commission. Once a final text is available, it will be approved and come into force.
