Carmen Zaragoza Sabaté is a senior associate of the Litigation and Arbitration Department of Garrigues, where she has pursued her entire professional career. She specializes in defending and acting as legal counsel for clients in civil and commercial lawsuits: obligations and contracts, noncontractual liability, real estate law, banking and financial law, enforcement proceedings, corporate law, unfair competition and intellectual property. Carmen Zaragoza has been a senior associate in the Litigation and Arbitration Department of Garrigues since 2018. She joined the firm in 2011. Over the course of her professional career, she has participated in extremely complex lawsuits, including
- Litigation relating to real estate and banking law: declaratory actions and actions to recover property, lease agreements, sale and purchase of real estate, foreclosures, enforcement of judicial and nonjudicial instruments, court auctions, financial products, lawsuits relating to assignment of receivables, disputed properties and properties with construction defects.
- Litigation relating to corporate law and the purchase and sale of companies: breach and termination of share purchase agreements, challenge of corporate resolutions, actions for liability against directors and auditors, shareholders’ right of withdrawal, and other lawsuits relating corporate disputes.
- Litigation relating to all kinds of contracts and civil and commercial obligations, including lawsuits concerning non-contractual liability.
- Litigation relating to the Unfair Competition Law and the Intellectual Property Law.
In addition to the above, Carmen also specializes in procedural law and the preparation of all kinds of court appeals, appeals to higher courts, cassation appeals before the Supreme Court and appeals for the protection of constitutional rights before the Constitutional Court.
She provides ongoing advice on contractual matters, on negotiations prior to and in parallel with court proceedings, and routinely offers strategic advice on civil and commercial matters relating to the above.
