Spain: From 20th March, companies will be required to designate a lawyer within two days

20th March 2024 will come into effect Royal Decree-Law 6/2023 of 19 December (RDL 6/2023), which amends the Law Regulating Social Jurisdiction (LRJS) and the Civil Procedure Law (LEC) to allow companies to adopt measures for better control of notifications and compliance with procedural obligations.

One of the main changes introduced in the LEC is the validity of the first summons of legal entities by telematic means, which will oblige companies to be very attentive to the notifications they receive through this channel. In this publication we detail some recommendations in this regard.

On the other hand, as part of the amendments to the LRJS, the Court Clerk will require the defendant to appoint a lawyer, graduate or solicitor within two days of notification of the admission for processing of the lawsuit, unless the defendants decide to litigate on their own behalf. To this end, the details of the lawyer, his or her postal address, e-mail address and telephone number must be provided. Since the deadline is so short, it is essential to be immediately aware of the notifications received from the labor courts in order to comply with this requirement.
