José David García Sotillo is a senior associate in the Litigation and Arbitration, and Restructuring and Insolvency practices. He joined the Malaga office in 2009 and provides advice on litigation and insolvency matters.
He specializes in the technical case management of all kinds of civil and commercial lawsuits in the civil jurisdiction, notably including court proceedings on banking law matters in defense of financial institutions and, in particular, ordinary enforcement and mortgage foreclosure proceedings and declaratory proceedings brought by consumers and users in relation to standard business terms.
He also provides recurring advice in financial distress situations and his work ranges from assisting debtors subject to technical or imminent insolvency in the process for negotiation and restructuring of debt, to defense of creditor claims and interests in formal insolvency proceedings and pre-insolvency procedures.
He has experience acting as legal counsel in court proceedings for eviction from business premises and has advised investment funds on the acquisition of assets in court auctions, analyzing the different possibilities for clients in order to minimize the potential contingencies and develop the best litigation strategy.
