Eduardo Fernández Goñi is a principal associate in the practice area of Litigation and Arbitration and in the practice area of Restructuring and Insolvency in Garrigues’s Barcelona office.
He has extensive experience in civil and commercial litigation and has appeared in court and arbitration proceedings involving, among others, debt recovery actions; disputes on the interpretation and performance of a range of contracts; the enforcement of in rem guarantees; corporate disputes; construction law; real estate; agency; distribution; and unfair competition.
He provides recurring advice on restructurings and business distress to both debtors facing situations of current or imminent technical insolvency and national and international creditors in defense of their claims as well as their interests in contractual relationships affected by formal insolvency proceedings. He also has a wealth of experience in preparing and formally petitioning for insolvency and in defending clawback actions. In this connection, a significant proportion of the recurring advice he provides centers on examining the possible risk of directors and executives being held liable, in the analysis of the resistance and risks of transactions with an insolvency dimension. He has also participated in the negotiation and formalization of numerous refinancing agreements and subsequent court approval proceedings.
He has been involved in countless transactions for the sale and valuation of mortgage claim portfolios (non-performing loans), and for the sale of companies or assets subject to insolvency proceedings.
