Restructuring and Insolvency

Debt refinancing

Debtor side: identifying which companies are to be refinanced and the type of refinancing (syndicated or bilateral), analyzing the classes of debt and creditors, and defining the goals of the process. Negotiating standstill agreements with financial institutions. Searching for new financing, asset sales and debt swaps. Finding and proposing alternative solutions to ensure the viability of the business (debt-for-equity swaps, payment rescheduling, interest deferrals, PIK loans, corporate debt issues, etc.).

Creditor side: analyzing the type of proposed refinancing, scrutinizing the security package, and examining the viability plan and debt repayment schedule. Preparing stress tests for security in the event of insolvency. Negotiating standstill and intercreditor agreements, drafting new security instruments or amendments for existing security instruments.
